Booking, Payment, and Cancellation Terms

These Booking, Payment, and Cancellation Terms apply to reservations confirmed directly with Sunny Maui Vacations, including reservations made through the Sunny Maui Vacations website.

Reservations confirmed through an external booking channel, including Airbnb, Vrbo, Booking.com, Expedia, or a comparable online travel marketplace, are governed by the payment schedule, cancellation policy, refund process, and guest terms presented by that channel at the time the reservation is confirmed. Sunny Maui Vacations rental terms, occupancy limits, house rules, property rules, damage policies, and property-specific requirements also apply to the extent they are disclosed to the guest and do not conflict with the applicable external booking channel terms.

By confirming a reservation, submitting payment, or accepting the rental policies during the booking process, the guest acknowledges and agrees to the terms applicable to the booking channel used to secure the reservation.

Vacation Condominium Reservations

For vacation condominium reservations confirmed directly with Sunny Maui Vacations, a fixed initial deposit of $250 is due at the time of booking and will be credited toward the total reservation amount.

The remaining balance is due 45 days prior to arrival and may be charged automatically to the credit card on file.

If a vacation condominium reservation is confirmed less than 30 days prior to arrival, the full reservation amount is due at the time of booking.

Vacation condominium cancellations are subject to the following terms:

Cancellations made 46 days or more prior to arrival are eligible for a refund, less any nonrefundable payment processing fees.

Cancellations made 22 to 45 days prior to arrival are subject to a cancellation fee equal to one night’s room charge.

Cancellations made 8 to 21 days prior to arrival are subject to a cancellation fee equal to two nights’ room charge.

Cancellations made 7 days or less prior to arrival are nonrefundable. Sunny Maui Vacations will retain 100 percent of the room charge.

Vacation Home Reservations

Vacation home reservations, luxury home reservations, and other designated high-value property reservations are subject to the following payment and cancellation terms.

A fixed initial deposit of $1,000 is due at the time of booking and will be credited toward the total reservation amount.

An additional payment equal to 50 percent of the remaining balance is due 60 days prior to arrival and may be charged automatically to the credit card on file.

The remaining balance is due 30 days prior to arrival and may be charged automatically to the credit card on file.

If a vacation home reservation is confirmed after one or more payment due dates have passed, all amounts then due are payable at the time of booking.

Vacation home cancellations are subject to the following terms:

Cancellations made 61 days or more prior to arrival are eligible for a refund, less any nonrefundable payment processing fees.

Cancellations made 30 to 60 days prior to arrival are partially refundable. Sunny Maui Vacations will retain 50 percent of the room charge. Any amount paid in excess of the retained cancellation amount will be refunded, less any nonrefundable payment processing fees.

Cancellations made 29 days or less prior to arrival are nonrefundable. Sunny Maui Vacations will retain 100 percent of the room charge.

Refunds and Payment Processing Fees

Approved refunds for direct bookings will be issued by check and mailed to the address on file.

For approved refunds greater than $250, the refund will be reduced by a 3 percent payment processing fee.

For purposes of these terms, “room charge” means the rental amount for the reservation. Room charge does not include refundable security deposits, taxes, cleaning fees, platform service fees, travel insurance, or other charges collected by an external booking channel, unless otherwise required by the applicable booking channel, payment processor, or law.

Sunny Maui Vacations is not responsible for platform service fees, payment processor fees, travel insurance premiums, or other charges collected or retained by an external booking channel or independent provider.

Failure to make any required payment when due may result in cancellation of the reservation. Any amounts paid may be retained according to the cancellation terms applicable at the time of cancellation.

Non Smoking Properties

All Sunny Maui Vacations properties are non smoking. Smoking is prohibited inside all properties and on all lanais, balconies, patios, and common areas where prohibited by law, association rules, property rules, or posted notices.

Violation of this policy may result in additional cleaning charges, damage charges, termination of occupancy, or other remedies available under these terms.

Rates, Taxes, and Fees

Published rates do not include applicable taxes, cleaning fees, damage protection, travel insurance, or other charges unless expressly stated.

The total reservation amount may include rent, cleaning fees, Hawaii General Excise Tax, Hawaii Transient Accommodations Tax, Maui County Transient Accommodations Tax, and any other applicable charges.

Rates, taxes, and fees are subject to change until a reservation is confirmed.

Vacation rental insurance

Vacation Rental Travel Insurance and Vacation Rental Damage Insurance has been made available with your reservation, via Generali Global Assistance. Vacation Rental Insurance reimburses for prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection.

If not purchased, you acknowledge you have read and understand our cancellation policy and choose not to purchase Vacation Rental Insurance on behalf of all occupants.

Responsible Guest Requirement

Sunny Maui Vacations rents only to responsible adults and family groups.

A parent or legal guardian at least 21 years of age must accompany all guests under 21 years of age for the full duration of the stay.

Reservations for high school groups, college groups, parties, events, or unauthorized gatherings are not permitted.

Sunny Maui Vacations reserves the right to reject a reservation, refuse occupancy, or terminate occupancy without refund if guest conduct violates these terms, property rules, association rules, applicable law, or creates an unreasonable disturbance, safety concern, or risk to the property.

Children and Minors

Adults traveling with children or minors are solely responsible for their supervision, safety, conduct, and any damage caused by them.

Pools, hot tubs, beaches, lanais, balconies, stairs, elevators, parking areas, and other property or common areas may present risks. Guests are responsible for exercising appropriate care and supervision at all times.

There may be no lifeguard on duty at pools, hot tubs, or beach areas.

Maximum Occupancy

Maximum occupancy is established for each property and may not be exceeded by overnight guests or day guests.

Only registered guests listed on the reservation are permitted to occupy the property unless prior written approval is provided by Sunny Maui Vacations.

Unauthorized guests, excessive occupancy, parties, events, or gatherings may result in additional charges, removal from the property, termination of occupancy, or cancellation without refund.

Arrival and Departure Times

The standard arrival time for vacation condominium reservations is 3:00 p.m., and the standard departure time is 11:00 a.m.

The standard arrival time for vacation home reservations is 4:00 p.m., and the standard departure time is 10:00 a.m.

Some properties may have different arrival or departure times based on property specific requirements. The arrival and departure times stated in the reservation confirmation, guest portal, or written arrival instructions will apply to the reservation.

Early arrivals and late departures are not guaranteed and must be approved in writing by Sunny Maui Vacations. Additional charges may apply for unauthorized early arrival, late departure, or failure to vacate the property by the scheduled departure time.

Cleaning and Property Condition

Each property is professionally cleaned and inspected before arrival and after departure.

Guests are expected to leave the property in reasonable condition. Additional charges may apply if excessive cleaning is required, if trash is not properly removed, if furniture or items are moved and not returned, or if the property requires unusual time or expense to restore to rentable condition.

Entry Access

For guest safety and property security, properties may be equipped with keyless entry systems. Access codes are changed before guest arrival whenever possible.

Guests may not share access codes with unauthorized persons.

Parking

Guests must follow the parking instructions provided in the reservation confirmation, welcome letter, guest portal, posted signage, association rules, or property specific instructions.

Parking is at the guest’s own risk. Sunny Maui Vacations is not responsible for loss, theft, towing, damage to vehicles, or damage to vehicle contents.

Losses and damages

We have learned that our vacationers do not travel hundreds of miles to damage a condo rental unit. At the same time, experience tells us accidents can and do happen. If such loss or damage does occur, Sunny Maui Vacations will charge an appropriate amount to the credit card on file unless a Damage Protection was in effect.
It will assist in expediting this process if you report any known losses or damages prior to your checking out.

Vacation rental damage protection

As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $1500. Any damages that exceed the $1500 Policy Limit or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $1500. Certain terms and conditions apply.

Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage of Insurance Policy. The Vacation Rental Damage plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Generali Travel Protection to pay directly Sunny Maui Vacations any amount payable under the terms and conditions of the Vacation Rental Damage. Amenities, Furnishings, and Supplies

All properties are individually owned, furnished, and decorated. Furnishings, decor, appliances, equipment, and amenities may vary by property and may change without notice.

Published photographs are intended to provide an accurate or similar representation of the property, but specific furnishings, decor, bedding, appliances, and supplies may vary.

Properties are equipped with a starter supply of basic toiletries and consumable items. Replenishment of these items during the stay is the guest’s responsibility unless otherwise agreed in writing.

Daily housekeeping is not included. Interim cleaning may be arranged for an additional charge, subject to availability and advance notice.

Pet Policy

Pets are not permitted in any Sunny Maui Vacations property unless expressly approved in writing by Sunny Maui Vacations before arrival.

Unauthorized pets may result in additional cleaning charges, damage charges, termination of occupancy, or other remedies available under these terms.

Service animals will be addressed in accordance with applicable law.

Noise, Conduct, and Quiet Enjoyment

Guests and visitors must conduct themselves in a manner that is respectful of neighbors, other guests, owners, association rules, property rules, and applicable law.

Quiet hours, if applicable, must be observed as stated in the guest information, house rules, association rules, posted signage, or property specific instructions.

Excessive noise, disruptive conduct, complaints from neighbors, unauthorized gatherings, unlawful activity, or conduct that creates a safety concern may result in removal from the property, termination of occupancy, and forfeiture of amounts paid.

Events Beyond Sunny Maui Vacations’ Control

Sunny Maui Vacations is not responsible for loss, damage, delay, inconvenience, interruption, or changes to a reservation caused by events beyond its reasonable control.

Examples may include, but are not limited to, weather events, natural disasters, fire, flood, road closures, airport closures, flight delays or cancellations, government action, emergency orders, utility outages, water interruptions, electricity interruptions, internet or cable interruptions, equipment failure, appliance failure, air conditioning failure, pool or elevator closures, nearby construction, beach conditions, ocean conditions, pests, insects, neighbor disturbances, civil unrest, labor disputes, or other circumstances outside the reasonable control of Sunny Maui Vacations.

Sunny Maui Vacations will make reasonable efforts to assist guests when unexpected issues arise and will work to address repairable matters as promptly as reasonably possible. No refund, relocation, or compensation is guaranteed for events or conditions beyond Sunny Maui Vacations’ reasonable control unless expressly required by law or agreed to in writing.

Property Access

Sunny Maui Vacations, its employees, representatives, vendors, contractors, repair personnel, association representatives, or emergency personnel may enter the property as reasonably necessary to inspect, maintain, repair, protect, or address issues at the property.

When practical, Sunny Maui Vacations will make reasonable efforts to notify the guest before entry. Advance notice may not be possible in emergencies, urgent maintenance situations, safety concerns, suspected violations, or circumstances requiring immediate access.

Liability and Indemnification

Guests occupy and use the property, common areas, amenities, parking areas, recreational equipment, beach equipment, and surrounding areas at their own risk.

To the fullest extent permitted by law, Sunny Maui Vacations, the property owner, and their respective employees, representatives, agents, and vendors are not responsible for injury, loss, theft, damage, expense, or claim arising from the guest’s occupancy or use of the property, common areas, amenities, equipment, or surrounding areas.

Guests agree to indemnify, defend, and hold harmless Sunny Maui Vacations, the property owner, and their respective employees, representatives, agents, and vendors from claims, liabilities, losses, damages, costs, and expenses arising from the acts, omissions, negligence, misconduct, occupancy, or use of the property by the guest, registered occupants, visitors, invitees, children, or pets, except to the extent prohibited by law.

Beach, Pool, and Recreational Equipment

Beach, pool, and recreational equipment may be provided as a convenience and is used at the guest’s own risk.

Guests are responsible for inspecting equipment before use and for using all equipment safely, lawfully, and appropriately. Ocean, beach, pool, and recreational activities involve inherent risks, and guests voluntarily assume those risks.

Sunny Maui Vacations and the property owner are not responsible for injury, loss, or damage resulting from use of beach, pool, or recreational equipment, except to the extent prohibited by law.

No Transfer, Resale, or Unauthorized Use

The reservation is valid only for the registered booking guest and the registered occupants approved for the reservation.

The reservation may not be transferred, assigned, resold, shared, or used by any person or group not listed on the reservation without prior written approval from Sunny Maui Vacations.

Only registered guests listed on the reservation are permitted to access or occupy the property.

Any unauthorized transfer, resale, occupancy, access, gathering, event, or use of the property may result in cancellation of the reservation, removal from the property, and forfeiture of amounts paid.

Agreement to Terms

By confirming a reservation, submitting payment, accepting the rental policies, accessing the property, or occupying the property, the guest acknowledges that they have read, understood, and agreed to these Rental Terms and Conditions.

The guest accepts responsibility for ensuring that all registered occupants comply with these terms, house rules, property rules, association rules, and applicable law.

Only registered guests listed on the reservation are permitted at the property. Unregistered guests, visitors, gatherings, events, or occupancy beyond the approved reservation are not permitted without prior written approval from Sunny Maui Vacations.
